These Terms apply to all users of AccessiTool, including free users, Pro subscribers, and enterprise clients. We reserve the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new Terms.

2. Use of Our Service

AccessiTool provides automated accessibility scanning tools that help websites comply with ADA, WCAG 2.1 AA, EAA, Section 508, and other global accessibility laws.

2.1 Free Plan

• 10 scans per month — each scan analyzes one website URL.
• Basic compliance reports — violations, warnings, and passed checks.
• Community support — via email and documentation.
• No signup required — you can scan without creating an account.

2.2 Pro Plan

• Unlimited scans — scan as many websites as you need.
• PDF reports — downloadable for legal documentation.
• 30-day history — access your scan history.
• Priority support — faster response times.
• Auto-renewal — subscriptions renew monthly unless canceled.

3. User Obligations

When using AccessiTool, you agree to:

• Provide accurate information — when creating an account or contacting us.
• Use the platform lawfully — don't use our tools for illegal or malicious purposes.
• Respect scanning limits — free accounts are limited to 10 scans per month.
• Don't abuse the platform — no automated scripts or bots that overload our servers.
• Protect your account — keep your password secure and notify us of unauthorized access.

4. Intellectual Property

All content, features, and functionality on AccessiTool — including but not limited to text, graphics, logos, software, and reports — are the exclusive property of AccessiTool and are protected by copyright, trademark, and other intellectual property laws.

• Reports: You may download and use compliance reports for your internal business purposes.
• Branding: You may not use AccessiTool's logos, trademarks, or brand elements without prior written consent.
• Reverse Engineering: You may not reverse engineer, decompile, or disassemble any part of our platform.

5. Disclaimer of Warranties

AccessiTool provides automated scans that may not detect all accessibility issues. Our tools are provided "as is" and "as available" without any warranties of any kind.

• No guarantee of compliance: Passing a scan does not guarantee full compliance with ADA, EAA, or other laws.
• No liability for decisions: We are not responsible for decisions made based on our reports.
• Third-party content: We are not responsible for content on websites you scan.

6. Limitation of Liability

To the fullest extent permitted by law, AccessiTool and its affiliates, officers, employees, and agents shall not be liable for any:

• Direct, indirect, incidental, or consequential damages arising from your use of the platform.
• Loss of data, revenue, or profits resulting from service interruptions or errors.
• Legal claims based on your website's accessibility or compliance status.

Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim (or $50 for free users).

7. Termination

We may terminate or suspend your access to AccessiTool at any time, with or without cause, including but not limited to:

• Violation of these Terms — misuse or abuse of the platform.
• Excessive usage — exceeding free plan limits without upgrading.
• Non-payment — for Pro subscribers with overdue payments.

Upon termination, your right to use the platform will immediately cease. Pro subscribers may be entitled to a prorated refund for unused time.

8. Pro Plan & Subscriptions

8.1 Pricing

Pro plan pricing is displayed on our website. All prices are in USD and may be subject to change with notice.

8.2 Billing

• Monthly subscriptions are billed in advance on a recurring basis.
• Auto-renewal: Your subscription will automatically renew unless you cancel at least 24 hours before the renewal date.
• Cancellation: You can cancel anytime from your account settings. No refunds for partial months.

8.3 Refund Policy

We strive for customer satisfaction. If you're unsatisfied, please contact us within 14 days of purchase. Refunds are evaluated on a case-by-case basis.

9. Privacy & Data Protection

We take your privacy seriously. Our Privacy Policy explains how we collect, use, and protect your personal data. By using AccessiTool, you consent to our data practices as described in the Privacy Policy.

• Scan Data: Your scan results are stored for up to 30 days (free) or 12 months (Pro).
• Email Communications: We may send you service-related emails (not spam).
• Data Security: We implement industry-standard security measures to protect your data.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of the United States.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or industry standards. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last updated" date.
• Email notification to registered users (for significant changes).

Your continued use of AccessiTool after changes constitutes acceptance of the new Terms.
